Acceptable Use Policy
Effective date: May 3, 2026
This Acceptable Use Policy (“AUP”) governs your use of the Lead Friendly platform (the “Service”) and is incorporated into the Terms of Service. Capitalized terms not defined here have the meaning given in the Terms.
1. Lawful use
You may use the Service only for lawful business purposes and in compliance with all applicable laws and regulations of every jurisdiction in which you, your end users, and the recipients of your communications are located.
2. Telephone and messaging compliance
You are solely responsible for compliance with all telephone, voice, messaging, and electronic-communications laws applicable to your use of the Service, including:
- The U.S. Telephone Consumer Protection Act (TCPA) and FCC implementing rules, including the FCC’s February 8, 2024 declaratory ruling treating AI-generated voices as “artificial or prerecorded”;
- The U.S. Telemarketing Sales Rule (TSR) and federal Do Not Call (DNC) registry;
- State telemarketing and telephone-consumer-protection laws, including (without limitation) Florida FTSA, Oklahoma TCPA, Maryland MTCPA, Texas SB 140, and Washington CEMA;
- Two-party (all-party) call-recording consent laws of every state in which a party to the call is located, including California, Connecticut, Delaware, Florida, Illinois, Maryland, Massachusetts, Montana, Nevada, New Hampshire, Pennsylvania, and Washington;
- CAN-SPAM, CASL, and equivalent commercial-email laws for any email you send through the Service;
- International equivalents (GDPR, UK GDPR, PECR, PDPA, etc.) where applicable.
Without limiting the above, you must:
- Obtain prior express written consent before using AI-generated voice for any marketing or telemarketing call to a U.S. consumer phone number;
- Scrub your contact lists against the federal, state, and your own internal Do Not Call lists at least every 31 days;
- Identify yourself, the business on whose behalf the call is made, and provide an opt-out mechanism at the start of every prerecorded or AI-voice call;
- Promptly honor “stop” and equivalent revocation requests in any reasonable manner.
3. AI voice agents — disclosure and integrity
- You must clearly and conspicuously disclose to recipients that they are speaking with an artificial-intelligence agent at the start of every call, in accordance with California SB 1001, Utah AIPA, the EU AI Act (where applicable), and good practice generally.
- You must not use the Service to clone, imitate, or impersonate the voice of any real person (including a public figure) without that person’s express written consent.
- You must not use the Service to impersonate any business, agency, or organization you are not authorized to represent.
4. Prohibited industries and content
You may not use the Service for, or in connection with:
- Adult, sexually explicit, or pornographic content;
- Illegal gambling or lotteries;
- Debt collection, credit repair, or credit-counseling activities without all licenses required by the FDCPA, CROA, and applicable state law;
- Multi-level marketing, pyramid, or chain schemes;
- Sale or marketing of firearms, ammunition, or explosives where prohibited;
- Sale or marketing of cannabis, kratom, or other substances where prohibited;
- Initial coin offerings, unregistered securities, “pump and dump,” or other prohibited financial promotions;
- Health-related claims that are unsupported, deceptive, or constitute miracle-cure marketing;
- Any business or end user located in a country subject to U.S. comprehensive sanctions (including, without limitation, Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine), or any party on the U.S. Treasury OFAC SDN list or equivalent restricted-party lists.
5. Prohibited conduct
You may not, and you may not permit any third party to:
- Send spam, unsolicited bulk communications, or communications that violate the rights of recipients;
- Engage in fraud, phishing, vishing, smishing, or social engineering;
- Harass, threaten, defame, or stalk any person;
- Distribute malware, ransomware, or otherwise compromise the security of any system;
- Reverse engineer, decompile, scrape, or attempt to derive source code from the Service, except to the extent expressly permitted by law;
- Resell, sublicense, or share access credentials except as expressly permitted by your subscription tier (e.g., Agency tier sub-accounts);
- Bypass, disable, or interfere with security, authentication, metering, billing, or rate-limit features of the Service;
- Use the Service to train any machine-learning model that competes with Lead Friendly;
- Conduct load-testing, penetration-testing, or vulnerability research against the Service without our prior written authorization.
6. Sensitive information
- Protected Health Information (PHI). Unless you have entered into a signed Business Associate Agreement (BAA) with Lead Friendly, you may not transmit, store, or process PHI through the Service. If you are a HIPAA-covered entity or business associate and need a BAA, contact us before any production use.
- Biometric data. If your use of the Service involves voiceprints or other biometric identifiers, you are responsible for providing all required notices and obtaining all required written consents under the Illinois Biometric Information Privacy Act (BIPA), Texas CUBI, Washington HB 1493, and any other applicable law.
- Card data. Do not collect or transmit raw payment card numbers, CVVs, or full magnetic-stripe data through the Service.
- Children’s data. The Service is not intended for collection of personal information from individuals under 13 (or under 16 in jurisdictions where that is the applicable age), and you may not use it for that purpose.
7. Bring-Your-Own-Carrier and number reputation
Where you bring your own SIP trunk or phone numbers, you remain responsible for STIR/SHAKEN attestation, carrier-level spam labeling, number registration, and 10DLC / TCR registration where required. We do not warrant that calls placed through the Service will receive any particular attestation level or avoid carrier spam labels.
8. Enforcement
We may investigate suspected AUP violations and take any action we consider appropriate, including warning you, suspending or terminating your account, blocking specific traffic, removing content, and cooperating with law-enforcement or regulatory authorities. Repeated or material violations are grounds for immediate termination without refund.
9. Reporting abuse
To report a suspected violation of this AUP, including spam, harassment, or unauthorized use of the Service, email hello@leadfriendly.com with the subject line “AUP Report.”
10. Changes
We may update this AUP from time to time. Material changes will be communicated by email or in-product notice. Your continued use of the Service after the effective date of an updated AUP constitutes acceptance.
